TERMS AND CONDITIONS

1. Operator and Scope

These Terms govern the websites replayed.shop, replayedusa.com, replayedhobby.com, and replayedcards.com and related pages and forms operated by Duncan-Deal LLC, doing business as Dun-Deal and RePlayed, based in Valdosta, Georgia ("RePlayed," "Dun-Deal," "we," "us," or "our").

2. Acceptance

By accessing or using the websites, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the websites.

3. Eligibility

The websites are intended for a general audience. Children under 13 may not submit forms or personal information. By using a form or making a submission, you represent that you have the legal capacity and authority to do so.

4. Current Website Purpose

The websites currently provide brand and product information, collection-submission and contact forms, and Coming Soon information. Online checkout is not currently active. Nothing on the websites is an offer to sell unless we expressly identify it as such.

5. Collection Submissions

You agree that information and photographs you submit are accurate to the best of your knowledge and that you own them or have permission to submit them. A submission does not guarantee an appraisal, offer, purchase, response, or transaction. We may accept, reject, or decline any submission or proposed transaction in our discretion, subject to applicable law.

6. Future Product Offers

Future products, availability, prices, quantities, release timing, shipping, returns, and other transaction terms may change and will be governed by the terms displayed when an offer is made. No orders are being accepted through the websites at this time.

7. Mystery and Repack Products

Repack and mystery products contain randomized contents. Unless a product-specific disclosure expressly says otherwise, no specific card, player, team, character, set, rarity, value, condition, grading company, or grade is guaranteed. Product-specific disclosures presented at the time of sale control if they conflict with a general description. Nothing in these Terms limits non-waivable statutory consumer rights.

8. Acceptable Use

You may not misuse the websites; interfere with their operation or security; attempt unauthorized access; submit unlawful, fraudulent, misleading, infringing, malicious, or harmful material; impersonate another person; scrape or copy content through automated means without permission; or use the websites in violation of law.

9. Our Intellectual Property

The websites and their RePlayed and Dun-Deal names, branding, logos, artwork, text, layouts, graphics, and other original content are owned by or licensed to us and are protected by applicable intellectual-property laws. No license is granted except the limited right to access the websites for lawful personal use.

10. Independent Brand and Trademark Notice

RePlayed and Dun-Deal are independent businesses and are not affiliated with, endorsed by, sponsored by, or associated with Pokémon, The Pokémon Company, Nintendo, Game Freak, Creatures Inc., Bandai, Bandai Namco, One Piece, Shueisha, Toei Animation, PSA, Collectors, Beckett Grading Services, CGC Cards, SGC, TAG Grading, HGA, Arena Club, ISA, or any other trading-card franchise, publisher, manufacturer, rights holder, or professional grading company. All third-party names, trademarks, logos, characters, and grading marks are the property of their respective owners. Their appearance in product artwork is solely for identification and does not imply sponsorship or endorsement.

12. Disclaimers

To the fullest extent permitted by law, the websites and their content are provided "as is" and "as available." We do not warrant that the websites will be uninterrupted, error-free, secure, current, or suitable for every purpose. Product images may be illustrative, and display colors may vary.

13. Limitation of Liability

To the fullest extent permitted by law, RePlayed, Dun-Deal, Duncan-Deal LLC, and their owners, officers, employees, agents, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or loss of opportunity arising from use of or inability to use the websites. Nothing excludes or limits liability that cannot legally be excluded or limited.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless RePlayed, Dun-Deal, Duncan-Deal LLC, and their owners, officers, employees, agents, and contractors from claims, damages, losses, liabilities, and reasonable costs arising from your unlawful misuse of the websites, your violation of these Terms, or material you submit that infringes another person's rights.

15. Suspension and Termination

We may restrict or terminate access to the websites when reasonably necessary to protect the websites, users, our rights, or comply with law. Provisions that by their nature should survive will survive termination.

16. Governing Law and Venue

These Terms are governed by Georgia law, without regard to conflict-of-law rules. Subject to applicable consumer-law rights, exclusive jurisdiction and venue lie in the state or federal courts serving Lowndes County, Georgia.

17. Changes

We may update these Terms by posting the revised version and changing the Last Updated date. Changes apply prospectively unless applicable law requires otherwise.

18. Severability, Waiver, and Entire Agreement

If a provision is unenforceable, it will be modified only as necessary and the remainder will continue. Failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement concerning use of the websites, except for any separate written transaction terms.
